Year-End Recalls & Lemon Law Red Flags

As the year winds down and everyone’s talking about who made Santa’s “naughty or nice” list, there’s one more thing that deserves a little judgment: your vehicle. Ford, Stellantis, and BMW top Santa’s “naughty” list this year for having the most recalls and safety issues in the third quarter of 2025, Lemon Law Attorney James Johnson says.

The end of the year is the perfect time to review your vehicle’s reliability and safety. Has it spent more time at the dealership than in your driveway? Does that check engine light keep coming back on? Was the same problem “fixed” over and over? If so, your vehicle might be on the naughty list—and it may be more than just an annoying car. It could be a potential lemon.

Sant’s Naughty List: Recalls vs. Lemons: What’s the Difference?
A recall is the manufacturer’s way of saying, “We found a defect, and we’ll fix it.” You can check your VIN on the manufacturer’s site or NHTSA’s website to see if your car has any open recalls. A recall does not automatically make your vehicle a lemon.

A lemon is usually a vehicle with:

  • The same problem that is repaired multiple times, especially if it affects safety, use, or value, or

  • Your car is stuck in the shop for an unreasonable number of days. In California, it’s 30 days or more.

  • A serious safety issue that could lead to injuries or death.

Sometimes, repeated recall-related repairs are part of that story. In the third quarter of 2025, topping Santa’s Naughty List was Ford which led the pack with 24 recalls this year, followed by Stellantis (13), BMW (8), Hyundai (7), Polestar and General Motors (5 each), Jaguar Land Rover and Kia (4 each), Honda, Mercedes-Benz, Porsche, and Volkswagen/Audi (3 each), Volvo, Lamborghini, Rivian, and Toyota (2 each), and Tesla, Nissan, Mitsubishi, Aston Martin, and Ferrari with 1 recall apiece—underscoring that problems can arise with nearly any brand and why strong lemon law protections matter.

During the third quarter, Back Over Prevention defects topped the recall list, affecting 1,749,524 vehicles, followed closely by Electrical System problems (1,668,743) and Fuel System (gasoline) issues (1,598,639), while major recalls also involved vehicle Structure (820,893) and Service Brakes, Hydraulic (811,435)—a reminder that serious safety defects are showing up across multiple critical systems.

Year-End Red Flags to Watch For
Before January 1, ask yourself:

  • Have I taken my car in 3 or more times for the same issue?

  • Has it spent weeks in the shop this year? Maybe the parts are unavailable to fix or or it’s unfixable.

  • Do I feel unsafe driving it?

  • Am I constantly being told, “We can’t find anything wrong,” even though the problem keeps happening?

If any of these sound familiar, it’s time to get serious about your rights.
