The owners of some 2010 Volkswagen Routan cars may have a claim under California Lemon Laws if their vehicle experiences repeated problematic repairs such as premature brake wear or other defects such as the engine shutting off suddenly while driving.
Volkswagen of America, Inc. issued a safety recall on some 12,612 of these models back in March 2011 when drivers began to experience inadvertent ignition key displacement that caused the vehicle’s engine to shut off while it was being driven. The models effected were manufactured between October 2009 and June 2010.
“The consequences of this safety issue is the driver could lose control of the vehicle and suddenly crash,” said Attorney James Johnson, a California Lemon Law Attorney.
However, these vehicles are also experiencing premature brake pad issues that are not addressed under the Volkswagen Routan recall, but have resulted in the manufacturer offering a buyback in some cases.
In fact, one of Johnson Attorneys Group’s recent Lemon Law clients was the owner of a 2010 Volkswagen Routan with roughly 65,000 miles on it. The owner told us they were experiencing premature brake wear had led them to return the vehicle for replacement pads on seven separate occasions. Although the brake pads were out of warranty and considered a wear item, the manufacturer offered our client a buyback as this is a known brake issue on the vehicle. The issue is also known to affect owners of Chrysler Town and Country vehicles in the 2009 and 2010 model years.
“Our Lemon Law client did not pay our attorney fees out of their settlement,“ said Johnson. “That’s because under California Lemon Laws, it’s incumbent upon the manufacturer to pay all attorney’s fees.”
